WHO THIS SERVICE IS FOR

Our services are intended for uncontested divorces - cases where both parties are generally cooperative, have reached agreement on the important issues, and simply want to legally dissolve their marriage.

WHEN TO SPEAK WITH AN ATTORNEY

If your matter involves disputed child custody, significant assets, disagreements about spousal support, or other complex legal issues, you should consult with a qualified family law attorney.

California's 6-Month Waiting Period

California requires a minimum six-month waiting period before a divorce can become final. The waiting period cannot be eliminated, but properly prepared paperwork can help reduce avoidable filing issues and delays.

LOW-INCOME APPLICANTS

If you have limited income, you may qualify for a waiver of court fees and costs. We can assist in preparing the fee waiver application and supporting documentation. If approved by the court, the waiver may reduce filing fees and court-related expenses by approximately $500. Applicants must provide documentation showing their current income.

Divorce Filing FAQs

  • Where can I file for divorce if I was married in another state?

You can get married almost anywhere, but you cannot necessarily get divorced anywhere you choose.

Unlike marriage, divorce is generally based on residency and jurisdiction. The fact that you were married in a particular state does not usually mean you can return there years later to file for divorce.

In most cases, you must meet the residency requirements of the state where you file.

  • Can same-sex couples married in California file for divorce if they no longer live there?

There is an important exception for same-sex couples.

If you were legally married in California but now live in a state or country that does not recognize your marriage and does not provide a way to obtain a divorce, you may be able to file for divorce in California even though neither spouse currently lives here.

  • Can I get a quick divorce in Nevada if I live in another state?

Nevada is often promoted as a quick and easy place to obtain a divorce. However, you cannot simply spend a couple of months in Nevada and assume you qualify as a Nevada resident for divorce purposes.

Nevada has specific residency and jurisdiction requirements that must actually be satisfied.

A divorce filed in a state where the residency requirements were not properly met can create significant legal problems later.

Before filing, make sure you are filing in the proper jurisdiction—not simply the fastest one.

  • Can a Nevada divorce affect my immigration case?

If you or your former spouse may need to rely on a divorce decree for immigration purposes, it is particularly important to ensure that the divorce was obtained in the proper jurisdiction.

We have seen cases where the validity and circumstances of a Nevada divorce became an issue during an immigration process.

Before filing for divorce, make sure you understand the applicable residency and jurisdiction requirements.

  • Can you help me prepare divorce paperwork in California?

Yes. We can assist with preparing the necessary divorce paperwork for your California filing.

If you are unsure whether you meet California's residency and jurisdiction requirements, we recommend consulting a qualified California family law attorney before proceeding.
